Hamilton Electric Bikes (HEB) Terms & Conditions
To safeguard your interests, it is imperative that you carefully review these conditions prior to placing an order with Hamilton Electric Bikes. These terms exempt Hamilton Electric Bikes and other entities from liability or impose limitations on their liability. This document constitutes a legally binding Agreement between you (referred to as “you,” “your,” or “user”) and Hamilton Electric Bikes (referred to as “us,” “we,” or “our”) pertaining to your access and use of our website, information, products, and services.
Every instance of utilizing the Website signifies your acceptance to be bound by the terms of this Agreement. If you do not concur with any provision of this Agreement, you are prohibited from accessing or using the Website.
1. Permission to Use Website
You are authorized to use the Website for purchasing products only if you are a resident of Canada, have reached the age of majority in your jurisdiction, and can form legally binding contracts under applicable law. It is your responsibility to ensure the lawfulness of your use of the Website. Hamilton Electric Bikes retains the right to request proof of identification and age.
Changes to this Agreement: We reserve the discretion to modify this Agreement concerning future Website use by posting a revised Agreement on the Website. Utilizing the Website after the posting of a revised Agreement implies your acceptance and agreement to be bound by the updated terms.
2. Pricing, Errors, and Omissions
Prices, pictures, and product descriptions on the website are subject to change without notice. We reserve the right to correct errors, revoke offers, cancel orders, and rectify inaccuracies or omissions even after an order submission has been made.
If a payment has been processed for an order that is subsequently cancelled due to an inaccuracy or pricing error, Hamilton Electric Bikes will issue a full credit to the original payment method. Please notify us within 30 days of any price or promotion discrepancies; after this period, we cannot offer retroactive refunds or credits.
3. Payment Methods & Sales Tax
All prices are listed in Canadian Dollars (CAD). Applicable provincial and federal taxes are calculated at checkout based on your delivery location. Accepted payment methods include Visa, MasterCard, and our integrated financing partners.
Fraud Prevention: The provided billing address must identically match the one on file with your issuing financial institution. In the event of a credit card authorization failure or a mismatch flagged by our anti-fraud software, we reserve the right to cancel your order without prior notification. Resolution of credit card holds or issues lies strictly between you and your issuing institution.
4. Inventory & Backorders
We make every effort to keep our website inventory updated. In rare instances, an item may fall out of stock before a shipment is processed. If a purchased item is on backorder or requires a special order, we will contact you immediately with an estimated arrival date. You maintain the right to authorize a substitute item, wait for the original inventory, or cancel the order for a full refund.

6. Vehicle Classification & Regulatory Compliance
Hamilton Electric Bikes sells electric mobility products manufactured under various power specifications. By purchasing a vehicle, you explicitly acknowledge the following regulatory frameworks:
- Compliance: Under the Ontario Highway Traffic Act (HTA), power-assisted bicycles and scooters operated on public roads, highways, sidewalks, or public multi-use paths are strictly capped at a maximum nominal motor output of 500 Watts and a maximum assisted speed of 32 km/h.
- Off-Road and Private Property Vehicles: Any vehicle sold by HEB featuring a nominal motor rating exceeding 500 Watts (including, but not limited to, 750W, 1000W, or mid-drive systems exceeding provincial thresholds) or capable of speeds above 32 km/h without pedaling is classified and sold strictly as an “Off-Road / Private Property Only” vehicle.
7. Assumption of Risk & Limits of Responsibility
The Purchaser assumes 100% of the legal, civil, and financial liability resulting from the operation of any out-of-spec or non-compliant vehicle on public infrastructure.
Hamilton Electric Bikes, its owners, partners, and its employees shall be held completely harmless and fully indemnified against any provincial Highway Traffic Act fines, municipal bylaws infractions, vehicle impoundments, civil personal injury lawsuits, property damage, or third-party liability claims arising from the illegal public operation of these vehicles, or from damages incurred during the operation or use of any product initiated by the user.
